Does remote proctoring invade students' privacy?
ProctorU adheres to the following privacy standards that protect students' personal information:
-Family Educational Rights and Privacy Act (FERPA).
-General Data Protection Regulation (GDPR). U.S.-based ProctorU became fully compliant with this EU regulation because the company serves test-takers in the EU. GDPR gives consumers much more control over their personal data and what it’s used for. Failure to protect consumer data from exploitation can result in stiff penalties.
-EU-U.S. and Swiss-U.S. Privacy Shield Framework. Joining the Privacy Shield Framework is voluntary. Once a company publicly volunteers to comply with the requirements, “the commitment will become enforceable under U.S. law.” The Framework requires a company to make it transparently known to consumers that they have the right to access their personal data.

What personal information will be collected, and why is it being collected?
For a proctored exam, you are requested to create a profile with ProctorU (Live+/Review+). The
information you provide when you create your profile is used to verify your identity on exam day. Some contact information is also collected. Your email address is only used to send reminders for your
upcoming exams, not for marketing purposes. Your phone number is used in case you are disconnected
from the exam and your proctor needs to contact you to help you reconnect.

The image taken of your Student or government issued ID will be deleted after seven (7) days. This image is
only used to verify your identity on the day of your exam.

program in accordance with industry standards and which must be able to protect the security and integrity
of the services being provided and the information being collected.
I’m not comfortable with a proctor looking around my room
In your Live+ exam the proctors are trained professionals who supervise and support many students on a
weekly basis. Proctors are bound by a code of conduct that requires them to act ethically and professionally
in all dealings with you and your information. The video recorded during your Live+ exam is only reviewed if
misconduct issues have been raised, either by the Proctor, or if you report any technical or disconnection
issues that may be reviewed in order to prevent similar issues arising with future exams
Has the Institute used ProctorU for exams before?
The Institute has been using ProctorU for its certification examinations since September of 2019. Student feedback was overwhelmingly positive and
confirmed that the service meets our requirements and has been thoroughly tested before being used by
more students and rolled out to all programs in 2021.
Does ProctorU record sessions?
While our technology allows us to record the sessions, we do not regularly record or take screen shots
unless an exam taker does something irregular that would require us to report the actions to the
university or organization. In the rare instances where video is recorded or pictures are taken, a copy is
sent to the university or organization for their review. ProctorU maintains these records for at least one
year, but the records are protected and are only shared with the institution, student or other authorities
as required by law.
What are the proctor fees if I missed a proctored session?
The fee is $99.97 to schedule an additional proctor session if you miss your first scheduled session for any reason.
Are the exams open or closed book?
All McAfee Institue exams are closed book.
European General Data Protection Regulation (GDPR)
The GDPR lays out specific requirements for businesses and organizations who offer goods and services to users in the European Economic Area. It regulates how businesses can collect, use, and share personal data and sets forth different obligations for “controllers” who determine the purpose and means of processing and “processors” who process personal information at the direction of controllers. In most contexts, ProctorU is a processor for controller educational institutions or certifying entities. ProctorU also takes measures to ensure that data transferred outside of the European Economic Area is protected in accordance with European law. For more information, please see our Privacy Policy and our Standard Contractual Clauses.
Why does my exam need to be proctored?
McAfee Institute board certified exams are proctored ensure the academic integrity of the examination of our board certifications and to satisfy our multiple accrediting bodies including Dept of Education, ANSI, Veterans Adminstration and Missour Police Officer Standards and Training.
Can ProctorU access all the personal data on my computer?
No, ProctorU cannot access your files. During the initial phase of the proctoring process, ProctorU, with
permission from the test taker, has the ability to view the screen and move their mouse and keyboard as
if the proctor was sitting next to the test taker. The proctor cannot access anything on the test taker’s
computer without the test taker’s knowledge. Once the examination is launched, the proctor will
change their permission to view only. During the monitoring phase, the proctor can monitor everything
that happens on the student's computer screen, but can no longer move the test taker's mouse and
keyboard. If something irregular occurs, the proctor can reinitiate the ability
to move the test taker’s mouse and keyboard, in which case the test taker is
alerted and can see everything that the proctor is doing. During this entire
process, an interface log, or chat box, is running on the test taker’s computer
and they can see what permissions the proctor currently has at anytime.
Finally, the entire session log is saved and there is a permanent record of
what actions the proctor took while accessing the test taker's computer.
Throughout the process, the student can see everything the proctor is doing
to their computer by watching them move their mouse.
Can personal information provided to ProctorU be deleted?
The Institute will request deletion of personal information as soon as results and all record management
activities are completed for the teaching session. The Institute owns this data not ProctorU. If you have
concerns, you can email admissions@mcafeeinstitute.com and request that your information is
deleted.
Has the Institute assessed the risk of using ProctorU?
The Institute conducted a thorough risk assessment as part of the evaluation of ProctorU’s practices,
including those related to student privacy and the protection of student data. Test taker data, such as
image capture during the exam, is only used in case of academic misconduct and access is limited to
authorised M.I. staff to ensure the integrity of the exam. The only information that is collected is that
which directly relates to the operation of the exam.
In addition, staff at McAfee Institute have done rigorous testing and security checks including scenario testing to
ensure there are no data breaches and the product that is offered to our students is of a high standard.
